Is CBD Legal?
The legality of CBD is still in the gray area. There are essentially three main legal authorities that need to be considered when determining whether CBD is legal: federal statutory law, state statutory law, and FDA regulations. From a federal statutory perspective, the 2018 Farm Bill included CBD within its definition of legal hemp as long as the hemp in which the CBD is derived contains no more than 0.3% THC. From a state statutory perspective, various states have various statutory laws related to CBD. Some states have no prohibition on selling CBD while other states prohibit CBD in food products or prohibit CBD altogether. From a FDA perspective, the FDA still does not authorize CBD to be sold as a dietary supplement or food additive and has come out with several statements regarding what can be included for labeling and marketing of CBD products.
Is Hemp Legal?
In 2018, the Agriculture Improvement Act of 2018 ("2018 Farm Bill") modified the definition of marijuana in the Controlled Substances Act ("CSA"). The definition of marijuana was modified to exclude hemp, which is defined as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers…whether growing or not, with a Delta-9 tetrahydrocannabinol ("THC") concentration of not more than 0.3 percent on a dry weight basis." Therefore, any cannabis plant or cannabis product with less than 0.3% Delta-9 THC on a dry weight basis is considered hemp and is excluded from the CSA. In other words, the 2018 Farm Bill explicitly made hemp and hemp products federally legal. But you still need to make sure that the hemp products are compliant with FDA regulations and state law.

Is Delta-8 THC Legal?
The 2018 Farm Bill modified the definition of tetrahydrocannabinols ("THCs") in the Controlled Substances Act ("CSA") to exclude "THCs" in hemp. Delta-8 THC is one of many cannabinoids naturally found within the cannabis plant. The starting concentration of Delta-9 THC in the cannabis plant material and the final concentration of Delta-9 THC in the final product will determine if the Delta-8 THC product is considered marijuana. Therefore, if Delta-8 THC is wholly derived from cannabis with less than 0.3% Delta-9 THC (i.e., hemp) and the final product contains less than 0.3% Delta-9 THC, it is considered a hemp product and is federally legal. The recent DEA IFR, however, has created some uncertainty within the hemp market relating to Delta-8 THC when it is synthesized from CBD isolate. The DEA IFR emphasized that synthetic THCs are not legal. However, it is our position that Delta-8 THC derived from CBD isolate from hemp is still legal because (1) the 2018 Farm Bill legalized hemp and all its derivatives; and (2) "synthetic" in this context generally refers to THC created entirely in the lab as opposed to being derived from a natural legal product like hemp. But you still need to make sure that the Delta-8 THC products are compliant with FDA regulations and state law.
Will hemp products show up in a drug test?
CBD products are unlikely to appear in a drug test. A user is screened for THC (the psychoactive cannabinoid) in a drug test. CBD is a separate cannabinoid from THC, therefore, CBD should not appear on a drug test. Yet, if a CBD product contains trace amounts of THC within the product, THC could appear in a user’s drug test.
