    • In 2018, the Agriculture Improvement Act of 2018 ("2018 Farm Bill") modified the definition of marijuana in the Controlled Substances Act ("CSA"). The definition of marijuana was modified to exclude hemp, which is defined as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers…whether growing or not, with a Delta-9 tetrahydrocannabinol ("THC") concentration of not more than 0.3 percent on a dry weight basis." Therefore, any cannabis plant or cannabis product with less than 0.3% Delta-9 THC on a dry weight basis is considered hemp and is excluded from the CSA. In other words, the 2018 Farm Bill explicitly made hemp and hemp products federally legal. But you still need to make sure that the hemp products are compliant with FDA regulations and state law.

  • Is Delta-8 THC Legal?

    • The 2018 Farm Bill modified the definition of tetrahydrocannabinols ("THCs") in the Controlled Substances Act ("CSA") to exclude "THCs" in hemp. Delta-8 THC is one of many cannabinoids naturally found within the cannabis plant. The starting concentration of Delta-9 THC in the cannabis plant material and the final concentration of Delta-9 THC in the final product will determine if the Delta-8 THC product is considered marijuana. Therefore, if Delta-8 THC is wholly derived from cannabis with less than 0.3% Delta-9 THC (i.e., hemp) and the final product contains less than 0.3% Delta-9 THC, it is considered a hemp product and is federally legal. The DEA IFR emphasized that synthetic THCs are not legal.   • Will hemp products show up in a drug test?
